TERMS AND CONDITIONS OF CONTRACT

1. Please understand that any representation by Paramount Fencing, Inc. regarding an installation date is for the customer’s convenience and is an approximation only. The installation date may be subject to change on a daily bases due to circumstances out of the control of Paramount Fencing, Inc., such as weather, permits, easement agreements, progress on prior scheduled jobs, etc.

2. In order to place the fence exactly where the customer desires it is imperative that the customer provides Paramount Fencing, Inc. with a land survey and exposed property pins. Therefore, if any of the above conditions are not met, Paramount Fencing, Inc. is not responsible for its location and the customer understands Paramount Fencing, Inc. will not be responsible for any claims arising from its location. If Paramount Fencing, Inc. agrees to assist customer this condition does not apply.

3. The customer understands that sometimes the proposed fence line may be subject to change. Sometimes underground obstructions such as cable limes, sprinkler lines, utility lines, and roots may alter its final location. In the event should this situation occur, the customer will be consulted first, but the proposed fence line and the anticipated result is ultimately subject to change.

4. Customer agrees to present a fence line that is free and clear of obstructions. Additionally, the customer understands that in order for the installation crew to install the fence correctly it will require a two foot clearance on each side of the proposed fence line. Obstructions, such as trees, bushes, debris, etc., may result in a trip ticket of $400 or may be subject to a clearing cost.

5. The proposed work anticipates that once work begins, Paramount Fencing, Inc. will be allowed to complete the scope of work without interruptions or stoppages from the customer, neighbors, or other contractors. In the event this situation should occur, it may result in a trip ticket of $400.

6. As a courtesy, Paramount Fencing, Inc. will notify Locates to mark underground utilities, but the customer understands that Locates does not mark sprinkler lines and it is the responsibility of the buyer to clearly mark them.

7. Customer understands that in no way does Paramount Fencing, Inc. offer any warranty on the material, only a one year craftsmanship. All warranties are as specified by the manufacture of such material.

8. Paramount Fencing, Inc. makes no warranty of merchantability or fitness of these products for any particular purpose. Additionally, customer agrees to indemnify and hold harmless Paramount Fencing, Inc. from any damages arising from any personal injury, incidental or consequential damages for any kind that may arise out of these products.

9. Customer understands that the property to be fenced may have deed, homeowner, city, or county restriction. It is the responsibility of the customer to comply with such restriction before ordering material.

10. All measurements in this proposal are approximations and the actual measurement may vary. Should the customer wish to add additional footage or change this proposal, the customer understands the proposed price is subject to change. Furthermore, the fence will be installed according to the industry standard. If it is not noted in the proposal, it is not included in the proposal price.

11. Any cancellation request must be made in writing prior to material purchase. Once material has been ordered, this contract is binding. Customer will be responsible for any cost that arises from direct cost such as, special material, permits, and 10% of the contract price may apply.

12. In the event a customer’s Home Owners Association prevents a timely install of the proposed fence line, the price may be subject to change, due to rising material cost. Additionally, the customer may be required to place a material deposit until the matter is resolved.

13. Contractor may at its discretion engage subcontractors to perform work hereunder, provided Contractor shall fully pay said subcontractor and in all instances remain responsible for the proper completion of this Contract.

14.  Contractor shall furnish Owner appropriate releases or waivers of lien for all work performed or materials provided at the time the next periodic payment shall be due.

PLEASE NOTE: WE ARE NOT RESPONSIBLE FOR UNDERGROUND UTILITIES AND SPRINKLER LINES. ALL FENCE LINES MUST BE CLEARED BY THE CUSTOMER PRIOR TO INSTALLATION. SURVEY STAKES MUST BE VISIBLE FOR INSTALLERS TO PROPERLY POSITION THE FENCE. UNFORESEEN DIGGING CONDITIONS MAY RESULT IN ADDITIONAL CHARGE. HOME OWNERS MUST OBTAIN HOA AND PERMIT APPROVAL IF REQUIRED.
